Terms & Conditions

Last Updated: October 14, 2026

Welcome to ForeclosureBuyHomes.com.

These Terms & Conditions govern access to and use of ForeclosureBuyHomes.com, including account registration, property information, auction participation, bidding features, alerts, electronic documents, communications, and related services.

By accessing this website, creating an account, registering to bid, or placing a bid, you agree to these Terms & Conditions and our Privacy Policy.

IMPORTANT NOTICE TO BIDDERS: Winning auction bids are non-transferable and may not be assigned to another individual, investor, LLC, corporation, or other legal entity, except where expressly authorized by controlling legal documents or applicable law. Please review Section 7 before placing a bid.

1. Eligibility

You must be at least 18 years old and legally capable of entering into binding agreements to create an account or participate in an auction.

Users must provide accurate, current, and complete information when creating an account or participating in an auction.

Each bidder is responsible for maintaining the confidentiality of their username, password, and account credentials and for all activity performed through their account.

ForeclosureBuyHomes.com reserves the right to verify eligibility before approving an account for bidding.

2. Registration and Bidder Accounts

An approved bidder account is required to place bids on properties offered through ForeclosureBuyHomes.com.

Users may be required to provide:

  • Full legal name

  • Email address

  • Telephone number

  • Mailing address

  • Username and password

  • Individual or business entity information

  • Proof of identity

  • Proof of funds

  • Business formation and authorization documents

  • Transaction-related documentation

Additional verification may be required before bidding or completing a transaction.

Bidder accounts may be designated as Pending, Approved, or Rejected. Only approved accounts are eligible to submit bids.

Approval to participate in one auction does not guarantee eligibility for all future auctions.

Individual and Business Entity Registration

Bidders purchasing as individuals must provide their accurate legal identity.

Bidders acting on behalf of an LLC, corporation, partnership, or other legal entity must identify the intended purchasing entity and provide requested authorization and verification documents.

Registration under an individual name does not automatically authorize purchasing under a different individual or business entity after the auction.

A business entity must be properly identified and approved in accordance with the applicable auction requirements.

3. Property Information and Due Diligence

Property information is provided for informational purposes and may originate from sellers, attorneys, referees, public records, third-party data providers, or other sources.

ForeclosureBuyHomes.com does not guarantee that all property information is complete, current, or accurate.

Bidders are responsible for conducting their own independent due diligence before placing a bid.

This may include reviewing:

  • Property condition

  • Title information

  • Liens and encumbrances

  • Outstanding taxes

  • Property occupancy

  • Zoning restrictions

  • Court records

  • Terms of Sale

  • Judgment of Foreclosure and Sale

  • Property-specific auction requirements

  • Any additional legal or financial obligations

Unless expressly stated otherwise in writing, properties may be offered as-is, where-is, subject to applicable law and the controlling Terms of Sale.

4. Bids Are Binding

By submitting a bid, you acknowledge that your bid may constitute a legally binding commitment, subject to the applicable Terms of Sale, court orders, seller requirements, attorney instructions, and governing law.

Bidders are responsible for ensuring that they have sufficient funds and the legal authority to complete the purchase.

Do not submit a bid unless you have reviewed the relevant property information, understand the auction requirements, and are financially prepared to complete the transaction.

By placing a bid, you acknowledge the No Assignment or Transfer of Winning Bids policy described in Section 7.

5. Highest Bidder Does Not Automatically Mean Completed

 Sale

Being identified by the website as the highest bidder does not automatically mean that the transaction is final or that ownership of the property has transferred.

A sale may remain subject to:

  • Seller confirmation

  • Referee confirmation

  • Court requirements

  • Execution of the Terms of Sale

  • Required deposit

  • Proof of funds

  • Attorney review

  • Applicable foreclosure judgment

  • Other property-specific requirements

The controlling Terms of Sale and legal documents for each property take precedence over these general website Terms to the extent of any conflict.

6. Post-Auction Requirements

After an auction ends, the successful bidder may be required to complete a post-auction purchase process.

The website may guide successful bidders through the following stages:

  1. Highest Bid: Review the auction result and any required confirmation.

  2. Buyer Information: Provide or confirm the approved purchaser’s information.

  3. Terms of Sale: Review and electronically sign the applicable documents where electronic signing is permitted.

  4. Proof of Funds: Submit required financial documentation for verification.

  5. Deposit: Follow the designated attorney, referee, or authorized escrow holder’s payment instructions and provide deposit confirmation.

  6. Confirmation: Receive confirmation of completion of the applicable website requirements after the required verification.

Completion of the website’s six-step process does not itself constitute a transfer of title, final closing, or satisfaction of any additional legal obligations.

Failure to satisfy required deadlines may result in consequences described in the applicable Terms of Sale, including loss of bidding rights, possible deposit forfeiture, resale of the property, or other remedies permitted by law.

The approved winning purchaser must remain consistent throughout the purchase process, subject to applicable legal requirements.

7. No Assignment or Transfer of Winning Bids

WINNING AUCTION BIDS ARE NON-TRANSFERABLE.

ForeclosureBuyHomes.com prohibits the unauthorized assignment, sale, transfer, or conveyance of a winning auction bid or associated contractual purchase rights to another individual, investor, LLC, corporation, partnership, or other legal entity.

7.1 Winning Bidder Identity

The individual or legal entity approved as the purchaser for an auction must remain the designated purchaser throughout the transaction, unless a change is expressly authorized under the controlling Terms of Sale, court order, or applicable law.

7.2 Prohibited Assignments

A winning bidder may not independently:

  • Assign the winning bid to another investor.

  • Sell or transfer the winning bid to another individual or company.

  • Substitute a different LLC, corporation, partnership, or other legal entity as purchaser.

  • Transfer the contractual right to purchase the property to another party.

  • Use a third party as a substitute purchaser without the required authorization.

  • Change the legal purchasing identity in an attempt to circumvent the auction requirements.

7.3 Individual and LLC Purchases

Bidders intending to purchase through an LLC or other business entity must identify the intended purchasing entity in accordance with the registration and approval requirements.

Winning an auction as an individual does not automatically authorize transferring the purchase to an LLC, even when the winning bidder owns or controls that LLC.

Likewise, winning an auction through an approved LLC does not automatically authorize substituting another business entity.

Any proposed change in purchaser identity must be reviewed under the applicable Terms of Sale and other controlling legal documents.

7.4 Buyer Information and Documentation

The successful bidder must provide accurate purchaser information and any required supporting documentation.

ForeclosureBuyHomes.com may compare the approved bidder information with submitted buyer information, entity documents, Terms of Sale, and other transaction records.

Discrepancies may require additional verification or review before the transaction can proceed.

7.5 Unauthorized Transfer Attempts

An attempted unauthorized assignment or transfer may constitute a violation of these Terms and the applicable Terms of Sale.

Such conduct may result in suspension of website privileges, review of the transaction, or contractual remedies where authorized by the controlling documents and applicable law.

No deposit forfeiture, cancellation, or other remedy shall occur solely by operation of this website provision where additional legal authority or procedures are required.

7.6 Controlling Legal Documents

A property’s Judgment of Foreclosure and Sale, court order, referee instructions, executed Terms of Sale, or other controlling legal documents may impose additional or different restrictions on assignments.

Those requirements shall govern in the event of a conflict.

By registering, participating in an auction, and submitting a bid, you acknowledge that winning bids may not be assigned or transferred in violation of these Terms or the applicable property-specific legal documents.

8. Deposits and Payment

Deposit requirements vary by property and are governed by the applicable Terms of Sale and legal instructions.

Certain foreclosure auctions may require a deposit equal to 10% of the successful bid. Other transactions may have different requirements.

The deposit amount, payment deadline, accepted payment method, and designated recipient must be verified for each transaction.

Depending on the controlling documents, deposits may be payable to a court-appointed referee, seller’s attorney, authorized escrow holder, or another legally designated recipient.

ForeclosureBuyHomes.com does not guarantee that the same deposit recipient, payment method, or deadline applies to every property.

Bidders must follow the verified payment instructions applicable to their transaction.

A website notification or uploaded payment confirmation does not independently establish that a deposit has been received or cleared.

Wire Fraud Prevention: Before transferring funds, bidders should independently verify payment instructions with the designated recipient using a trusted telephone number. Changes to wire instructions received by email should not be relied upon without independent verification.

9. Electronic Signatures and Records

Where permitted by applicable law and the controlling transaction documents, users consent to the use of electronic signatures, acknowledgments, and records in connection with website transactions.

Electronic signature services may be provided through authorized third-party platforms.

Property-specific documents may impose additional execution, delivery, notarization, or recordkeeping requirements.

Nothing in these Terms requires electronic signatures where they are prohibited or where a party is legally entitled to use another permitted method.

10. Auction Availability and Technical Issues

ForeclosureBuyHomes.com does not guarantee uninterrupted or error-free website operation.

Technical failures, internet interruptions, server errors, plugin failures, bidding-system errors, or other disruptions may occur.

Where legally permitted, an auction may be delayed, extended, suspended, rescheduled, or otherwise handled in accordance with the applicable Terms of Sale and auction requirements.

The website’s displayed bid status is subject to applicable verification and confirmation requirements.

11. No Legal, Tax, or Investment Advice

Content on ForeclosureBuyHomes.com is provided for informational purposes.

Nothing on this website constitutes legal, tax, financial, investment, or title advice.

Users should consult their own attorney, accountant, title professional, lender, or other qualified professional before participating in any real estate transaction.

12. Communications

By creating an account or participating in an auction, you consent to receive transactional communications relating to:

  • Account activity

  • Bidder verification and approval

  • Auction activity

  • Bid status

  • Property updates

  • Required documents

  • Transaction deadlines

  • Security notices

  • Deposit verification and purchase status

Marketing communications will be handled separately, with consent and opt-out options where required by law.

Users are responsible for maintaining accurate contact information and reviewing transaction-related notifications.

13. Account Suspension or Termination

ForeclosureBuyHomes.com may restrict, suspend, or terminate account access where reasonably necessary to protect the auction process, users, or website, including circumstances involving:

  • Fraud or suspected fraud

  • False or misleading information

  • Unauthorized account use

  • Attempted manipulation of an auction

  • Violation of these Terms

  • Failure to comply with property-specific requirements

  • Attempted unauthorized assignment of a winning bid

  • Submission of inaccurate purchasing entity information

Suspension or termination of website access does not automatically extinguish any contractual obligations arising from an existing bid or transaction.

14. Third-Party Services

The website may use third-party providers for auction functionality, account management, payment coordination, electronic signatures, email communications, analytics, hosting, or related services.

These may include WooCommerce, YITH, electronic-signature providers, attorneys, referees, title companies, escrow providers, and other transaction-related service providers.

Use of third-party services may also be subject to their respective terms and policies.

ForeclosureBuyHomes.com does not guarantee the independent performance of third-party services.

15. Intellectual Property

Website content, branding, graphics, layout, text, and other protected materials may not be copied, reproduced, distributed, or commercially exploited without authorization, except where permitted by law.

Users may access and retain documents made available to them for lawful personal review and participation in authorized transactions.

16. Limitation of Liability

To the fullest extent permitted by applicable law, ForeclosureBuyHomes.com and its operators disclaim liability for losses arising from:

  • Reliance on incomplete or inaccurate property information

  • User error or misrepresentation

  • Unauthorized account access

  • Technical interruptions

  • Third-party service failures

  • Failure to complete required due diligence

  • Failure to comply with applicable auction requirements

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

17. Governing Documents

If these Terms conflict with a property-specific:

  • Judgment of Foreclosure and Sale

  • Terms of Sale

  • Memorandum of Sale

  • Court order

  • Referee instruction

  • Binding attorney or escrow instruction

  • Other controlling legal document

the applicable controlling legal document governs with respect to that transaction.

These general website Terms do not amend or supersede an existing court order, executed purchase agreement, or other binding transaction document.

18. Changes to These Terms

These Terms may be revised periodically.

An updated version will be posted on the website with a revised date.

Changes will apply prospectively to the extent permitted by law and will not automatically modify the terms of a previously executed agreement or completed auction transaction.

Users are encouraged to review these Terms before registering for or participating in each auction.
